Witness Testimony
In 2025, Sajecki Planning was retained by the City of Toronto to provide planning expert witness services in opposition of an official plan and zoning by-law amendment application at 69 Yorkville Avenue. The original application for a 29-storey mixed-use building was refused by the City of Toronto, largely on the basis of height. The decision was appealed with a revised 39-storey concept submitted to the Ontario Land Tribunal. Key issues revolved around the appropriateness of the proposed height and density within the low-rise Village of Yorkville and associated conformity with the Official Plan, Downtown Plan, and Site and Area Specific Policy 211.
Based on evidence provided in part by David Sajecki, the Tribunal dismissed the appeal, thereby reinforcing the existing policy framework and supporting context-sensitive development within the historical and culturally rich Village of Yorkville.
